What is Title IX?

Title IX of the Education Amendment of 1972 is a federal civil rights law that prohibits sex discrimination on the basis of sex in an educational institution’s programs or activities, including employment, academic, educational, extracurricular, and athletic activities (both on and off-campus).

Title IX protects against sexual assault and misconduct that impairs or interferes with access to equitable educational and employment opportunities. It applies to all members of the campus community, including students, District employees, individuals doing business with the campus, those using campus facilities, and those who engage in volunteer activities.

What are my rights under Title IX?

You have the following rights under Title IX, to the extent applicable within NOCE and the NOCCCD District:

  • You have the right to fair and equitable treatment and shall not be discriminated against based on your sex.
  • You have the right to have access to a gender equity coordinator to answer questions regarding gender equity laws.
  • You have the right to contact the State Department of Education and the California Interscholastic Federation to access information on gender equity laws.
  • You have the right to file a confidential discrimination complaint with the United States Department of Education Office for Civil Rights or the California Department of Education if you believe you have been discriminated against or if you believe you have received unequal treatment on the basis of your sex.
  • You have the right to pursue civil remedies if you have been discriminated against.
  • You have the right to be protected against retaliation if you file a discrimination complaint. (California Education Code section 221.8)

Title IX Training For Students

Starting September 1, 2024, AB 2683 mandates annual sexual violence and harassment training for California Community College students. Training must be completed within six months of the academic year’s start. If the training may cause you trauma or harm, contact NOCE’s Title IX office for alternatives. You can access the training through the link below. Failure to complete the training will not impact your ability to register for classes.

  • What to do if you’ve been sexually assaulted?

    Go to a safe place.

    If you are in fear of your safety, call the police (911) immediately, especially if the assailant is still nearby. For an assault on any of the three NOCE Centers, call the Campus Safety Office at the center you are at:

    Seek emotional care and support.

    Don’t try to deal with this situation alone. Call someone you feel you can talk to. The Rape Crisis Hotline has counselors available 24 hours a day at (714) 957-2737 or (949) 831-9110.

    Get medical attention as soon as possible to assess and treat physical injuries you may have sustained and to collect evidence of the assault.

    Help preserve evidence. You do not have to decide immediately whether or not you want to pursue a criminal complaint.

    Consider reporting the assault to the campus Title IX Coordinator and/or to the police.

    Telling the police does not commit you to further legal action.

    This experience was NOT your fault.

  • Campus Interim Actions

    Upon request, NOCE will make any reasonably available change to a victim’s academic and/or working situation. Examples of interim actions include: shielding a student from ongoing contact with an individual; taking an individual out of a class or issuing an administrative no-contact order; assigning an individual to a different lab or other clinical or work setting.

  • Reporting Options

    Report to Law Enforcement

    If you are a survivor of sexual assault, you have the choice to report the crime to local law enforcement. You can also report the crime to Campus Safety if the assault occurred on campus.

    Reporting on Campus

    Formal complaints of violations of NOCCCD’s Sexual Misconduct and Harassment Policies are filed through the Title IX Coordinator at NOCE, Martha Gutierrez, Vice President of Student Services.

    Medical Exam

    Students are strongly encouraged to seek medical attention and support, regardless of when the incident occurred, to be treated for any injuries, given prophylactic antibiotics, and offered emergency contraceptives.

    In Orange County, sexual assault exams are conducted at Anaheim Regional Medical Center. A police officer is required to authorize the exam.

    Physical evidence from a sexual assault must be collected within 96 hours of assault. It is important that you do not wash yourself or your clothing before the examination.

    Please Note: You do not have to press charges, testify, or file a report to have a sexual assault examination completed. The state may hold the evidence for a certain number of days while you decide if you would like to make a formal report to the Police.

    Alcohol and Other Drugs

    If someone is drunk, they can NOT legally give consent. If you are underage, you will not get in trouble with the District if you report a sexual assault that happened to you while you were drinking.
